$89 Million Nationwide Class Action Settlement Approved in Bextra and Celebrex Case

Fourth Largest Pharmaceutical Settlement Received in United States History

MIAMI – On September 25, 2009, The Honorable Charles R. Breyer, United States District Judge for the Northern District of California, in San Francisco approved the $89 Million proposed nationwide class action settlement with Pfizer, Inc. involving the marketing of the prescription drugs Bextra and Celebrex. The settlement funds will be distributed to consumers and insurance companies or other entities, such as third-party payors that purchased either medicine before July 29, 2005.

“We’re pleased with the Court’s approval of the proposed settlement, and feel that the funds were allocated fairly to all those involved,” said Lance Harke.

The Miami-based commercial litigation and consumer class action law firm of Harke & Clasby LLP, (www.harkeclasby.com) served as consumer allocation counsel for the Bextra or Bextra and Celebrex Consumer Subclass and assisted the court in dividing the settlement funds between Bextra and Celebrex consumers, along with third party payors, such as providers, insurance companies, union health and welfare plans, and self-insured employers.

The lawsuit claimed that Pfizer falsely advertised Bextra and Celebrex as having greater benefits than less expensive pain medications, causing consumers and other entities to pay a greater price for Bextra and Celebrex than they would have otherwise paid for less expensive alternatives. The lawsuit also claimed that the advertising was not consistent with Food and Drug Administration approved labeling.
